Welcome to Pref. These are the rules of the road for using the Pref app and website (together, the “Service”) operated by Becker Capital Ventures LLC (“we”, “us”). By creating an account or using the Service, you agree to these terms. This is a draft — we'll tighten the legal language before the app leaves private beta, but the substance won't change.

1. Who can use Pref

You must be at least 13 years old to create an account. If you're between 13 and the age of majority in your country, you confirm that a parent or guardian has agreed to these terms on your behalf. Business accounts must be created by someone authorized to bind the business.

2. Your account

• You sign in with your phone number via a one-time SMS code. Keep your phone and SIM secure — anyone who can receive your texts can sign into your Pref account.
• One account per person, please. You're responsible for the activity on your account.
• You can delete your account at any time from Settings → Account. See the Privacy Policy for what happens to your data.

3. Your content

The preferences, photos, notes, and other content you add to Pref are yours. You keep ownership of everything you upload.

By adding content to Pref, you grant us a worldwide, royalty-free license to host, display, reproduce, and transmit that content solelyas needed to run the Service — for example, storing a preference so we can show it back to you, rendering your profile for a friend you've shared with, or passing a preference's text to our AI assistant when you ask for a summary. We don't use your content to train third-party AI models, and we don't sell it.

When you share a preference, profile, or link with another person or business, you're authorizing us to display that content to them. You can revoke any share at any time.

4. Acceptable use

Pref is a tool for the little things that make you feel seen. Be kind to the people you share with, and to the people whose preferences you receive. In particular, don't:

• Harass, threaten, or impersonate anyone, including people whose preferences have been shared with you.
• Record or share preferences on behalf of someone else without their permission (dependents excepted — see below).
• Use Pref to spam, phish, scrape, or reverse-engineer the Service.
• Upload content that's illegal, violates someone's privacy, infringes intellectual property, contains malware, or is pornographic.
• Use automated tools (bots, scripts, scrapers) to interact with the Service without our written permission.

5. Dependents

You can record preferences on behalf of a child, pet, or other adult in your care, but only if you're their parent, legal guardian, or otherwise authorized to do so. You're responsible for the accuracy of those preferences and for deleting them when the relationship changes.

6. Businesses and hosts

If you use Pref as a business (restaurant, hotel, clinic, venue), you agree to treat guests' preferences with discretion and care. Do not share a guest's preferences with a third party without their consent, and do not retain them after your working relationship ends.

7. Pref is not a safety system

Pref is a way to communicate preferences, not a medical, safety-critical, or legal record. If you have a severe allergy or medical condition, always confirm directly with the person preparing your food or delivering your care. We can't guarantee that a recipient of a shared preference will read, understand, or act on it, and we aren't liable for outcomes that depend on them doing so.

8. Our content

The Pref name, logo, mascot (Pina the pineapple), app screens, and the preference catalog we author are ours. You're welcome to talk about Pref, link to us, and share screenshots of your own profile. Don't copy or redistribute our catalog, design, or brand assets without written permission.

9. Third-party services

Pref relies on third parties to run (Twilio for SMS, Google Gemini for AI features, Railway for hosting, and the Apple App Store and Google Play for distribution). Your use of the Service is also subject to their terms. We're not responsible for outages or changes on their side.

10. Termination

You can delete your account at any time. We can suspend or terminate your account if you violate these terms, if your account has been inactive for a long period, or if we're legally required to. If we terminate your account for a violation, we'll tell you why unless doing so would be illegal or would compromise an investigation.

11. Disclaimers

Pref is provided “as is”. We do our best to keep the Service running and secure, but we don't promise it will be uninterrupted, error-free, or fit for a particular purpose. The accuracy of a preference depends on the person who entered it; we don't verify preferences against medical records or other sources of truth.

12. Limitation of liability

To the fullest extent permitted by law, Pref and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of your use of the Service. Our total liability to you for any claim will not exceed the greater of $50 or the amount you've paid us in the 12 months before the claim.

13. Changes to these terms

We'll update this page when terms change and bump the “last updated” date. For material changes we'll notify you in-app. Continuing to use Pref after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute that can't be resolved informally will be brought in the state or federal courts located in San Francisco County, California — unless local law in your jurisdiction requires otherwise.
